I slipped and fell at work and broke my elbow. I had to have reconstructive surgery. Workmans Comp is taking care of bills and i have to stay out of work for a realy long time. People say i should sue because in the future i could have problems with my arm. I have no medical insurance to take care of these problems. I don't want to sue but i feel i should be taken care of in the future if any problems arise. Need serious advice PLEASE!

You should sue. Get yourself in a posistion where fear in your life is no longer necessary and continue working. You might not be able to do the same job and workmans comp might not take of everything so you need a plan b, and a fall out just incase.

really i feel that if they have been the one essentially taken care of u so its fucked up to sue them. and i know a lot of ppl will disagree but u have to b a moral person too.ill give u an example ,when my dad was in the military he had a bad operation reattaching his esophagus so though out his life coupled with drinking created a terrible ulcer to grow on the outside of his stomach lining eventually the ulcer burst and my dad died.now i don't no ur situation but i know in my case we could have sued but we didn't and those were the ppl that took care of us, they saved us when we had no one. the real question is do u respect these ppl, do u believe in this company,do u care? thats where morals come in not money

If the company provided all of the proper training and safety equipment, you'd be hard-pressed to win a lawsuit. You could instead look into Workers Compensation. ---- From Wikipedia: "While plans differ among jurisdictions, provision can be made for weekly payments in place of wages (functioning in this case as a form of disability insurance), compensation for economic loss (past and future), reimbursement or payment of medical and like expenses (functioning in this case as a form of health insurance), and benefits payable to the dependents of workers killed during employment (functioning in this case as a form of life insurance)." ---- If you do intend to sue, you would be suing for pain and suffering and claiming that your quality of life has declined due to your inability to work as a result of your injury. It's really up to you, but keep in mind pain and suffering usually doesn't work for workers comp.

Consult with a workers comp attorney in your state. In some cases, if a company particicpates in workere comp, you cannot sue them. However, you might get wage compensation thru workers comp with help of an attorney, or better benefits. Talk to a lawyer. Your friends know you, but they don't know the law.
